The rules need an independent referee
Political disagreement and constitutional disagreement are not the same thing. Elected bodies should make political decisions. A separate constitutional body should decide genuine disputes about what the permits.

The referee cannot belong to one team
A body that may have to review the actions of elected leadership cannot depend on that same leadership for its decisions, membership or continued existence.

Members need a route to constitutional review
A constitutional safeguard has little value if only the institutions being reviewed can activate it.
The rules should define who may bring a constitutional question and on what basis.

Some disputes cannot wait for months
When a constitutional dispute affects an ongoing confidence process or another urgent institutional decision, review must happen quickly enough to matter.
